Understanding HIPAA Requirements for AI

The Health Insurance Portability and Accountability Act (HIPAA) establishes standards for protecting sensitive patient health information. When healthcare organisations use AI tools, these requirements do not change — they must be applied to the AI systems just as they are applied to any other technology that handles protected health information (PHI).

The fundamental question is straightforward: does the AI system access, process, store, or transmit PHI? If yes, HIPAA compliance is required. This applies to clinical documentation tools, billing systems, scheduling platforms, patient communication tools, and any other AI application that touches patient data.

Key Compliance Requirements

Business Associate Agreement (BAA)

Any AI vendor that accesses PHI must sign a Business Associate Agreement with your organisation. This contract establishes the vendor's obligations for protecting PHI, including security measures, breach notification procedures, and data handling restrictions. If an AI vendor will not sign a BAA, they cannot be used for any workflow involving patient information.

Data Encryption and Security

PHI must be encrypted both in transit (when being sent to the AI system) and at rest (when stored by the AI system). The AI vendor's security infrastructure must meet or exceed industry standards, including SOC 2 Type II certification and regular security audits.

Access Controls

The AI system must support role-based access controls, ensuring that only authorised personnel can access patient information through the tool. Access logs must be maintained and auditable.

Data Minimisation

Only the minimum necessary PHI should be shared with AI systems. If an AI agent needs to draft a patient appointment reminder, it needs the patient's name, appointment details, and contact information — not their full medical record.

Audit Trails

Every interaction between the AI system and PHI must be logged and auditable. This includes what data was accessed, when, by whom, and what outputs were generated. These logs must be retained according to your organisation's record retention policies.

Practical Guidelines for Healthcare Teams

Evaluate before you adopt. Before using any AI tool with patient data, conduct a formal risk assessment covering data handling, security controls, and compliance capabilities.

Separate clinical and non-clinical use. Many AI tasks in healthcare — such as drafting general educational content, analysing anonymised operational data, or researching clinical guidelines — do not involve PHI and can use standard AI tools. Reserve HIPAA-compliant tools for workflows that actually touch patient data.

Train your team. Healthcare staff need to understand which AI tools are approved for PHI, what types of information can and cannot be entered into AI systems, and how to report potential compliance concerns.

De-identify when possible. If you can accomplish your objective with de-identified data, do so. AI analysis of aggregate trends, operational patterns, and workflow efficiency often does not require individual patient identification.

The Vendor Landscape

A growing number of AI vendors offer HIPAA-compliant deployments specifically designed for healthcare organisations. These include enterprise versions of major AI platforms, healthcare-specific AI tools, and on-premises deployment options that keep data within your organisation's infrastructure.

When evaluating vendors, ask specifically about: BAA availability, data residency (where data is stored and processed), data retention and deletion policies, training data practices (whether your data is used to train AI models), and incident response procedures.
